NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS
FOR TIERED PROJECTS AND PROGRAMS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Farmington Hills. On or about October 13, 2026, the City of Farmington Hills will submit a request to the Office of Community Planning & Development, U. S. Department of Housing and Urban Development for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project(s):
Tier 1 Broad Review Project/Program Title: Housing Rehabilitation Program
Purpose: A city administered program to provide technical and financial assistance to low-moderate-income residents of the city to rehabilitate owner-occupied single-family houses on a city-wide basis. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known.
Location: undetermined addresses/city-wide
Level of Environmental Review Citation: 24 CFR 58.5(a)(3)(i).
Tier 2 Site Specific Review: The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: 24 CFR 50.4 & 58.6:, Contamination and Toxic Substances, Historic Preservation, Floodplain Management, Noise Abatement and Control.
Mitigation Measures/Conditions/Permits (if any):
Contamination and Toxic Substances: During Tier 2 site-specific reviews, the City of Farmington Hills will determine if the draft scope of work for any home in the program is exempt from a lead-based (LBP) hazard evaluation. If the draft scope of work requires a risk assessment, the City of Farmington Hills’ consultant will perform the LBP inspection and risk assessment. The results will be provided to the homeowner and incorporated into the final scope of work bid packet. At the conclusion of projects involving the clearance of LBP, a clearance test will be performed, shared with the homeowner, and retained at the Tier 2 level. During the development of the draft scope of work, the City of Farmington Hills will also conduct a visual inspection for the presence of toxic substances. Testing, remediation efforts, and the incorporation of report findings will be retained at the Tier 2 level and shared with the homeowner.
Historic Preservation: All homes in the program will be subject to evaluation via Section 106 consultation with the Michigan State Historic Preservation Office. Direction will be taken based on SHPO’s determination. Documentation will be retained at the Tier 2 level.
Floodplain Management: All homes in the program will be subject to evaluation of floodplain status using the National Flood Hazard Layer Viewer. If located in a floodplain, determination will be made if exceptions apply. If an exception does not apply, determination will be made whether an 8-step Process is required. Documentation will be retained at the Tier 2 level.
Noise Abatement and Control: All homes in the program will be subject to evaluation for potential noise generators in the vicinity of the project. All practical efforts will be made to reduce noise levels to acceptable compliance standards including improved building envelope components, where applicable. Documentation will be retained at the Tier 2 level.
Estimated Project Cost: CDBG funding $288,970, plus an estimated $50,000 in program income.
Determination: The activity proposed is categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per Categorically Excluded Subject to 58.5, per 24 CFR 58.35(a)3(i)(ii) – rehab of residential buildings. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at City of Farmington Hills, Community Development Office, 31555 W. Eleven Mile Road, Farmington Hills, MI 48336 and may be examined or copied weekdays 8:30 AM to 4:30 PM.
PUBLIC COMMENTS
Any individual, group or agency may submit written comments on the ERR to the Community Development Office by email to temmanuel@fhgov.com or mail. All comments received by October 12, 2026, will be considered by the City of Farmington Hills prior to authorizing submission of a request for release of funds.
ENVIRONMENTAL CERTIFICATION
The City of Farmington Hills certifies to HUD that Karen Mondora, Certifying Officer, in her capacity as Acting City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Farmington Hills to use HUD Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Farmington Hills’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Farmington Hills; (b) the City of Farmington Hills has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR, Part 58, Sec. 58.76) and shall be addressed to U.S. Department of Housing and Urban Development - Detroit Field Office, Keith E. Hernandez, Director of Community Planning and Development at DetroitCPD@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
